These Terms of Use govern your access to and use of Fragments ("the Service"), operated by Kareem Elsamadicy ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these terms.
1. Description of Service
Fragments is a private writing tool in beta that transforms and reshapes written text using AI. It is designed for individual writers who want to explore, develop, and protect their writing. The Service is currently in beta, which means it is under active development and subject to change.
2. Account Requirements
You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 18 years old to create an account. You may not create accounts on behalf of others without their consent.
3. Your Writing and Intellectual Property
You retain full ownership of all writing you submit to the Service. Fragments does not claim any intellectual property rights over your text, the transformed outputs, or any derivative content produced by the Service. Your writing is yours — before, during, and after transformation.
The text you submit is processed by Anthropic's Claude API to generate transformations. Anthropic's handling of data sent through their API is governed by Anthropic's usage policies. We do not use your writing to train AI models, and we do not sell or share your writing with third parties for any purpose other than delivering the Service.
4. Acceptable Use
You agree not to use the Service to: (a) submit content that infringes on others' intellectual property rights; (b) submit unlawful, abusive, or harmful content; (c) attempt to reverse-engineer, scrape, or automate access to the Service; (d) use the Service to generate content intended to deceive or harm others; (e) circumvent access controls or payment systems; or (f) use the Service in any way that violates applicable law.
5. Beta Disclaimer
The Service is provided in beta form. Features may change, be removed, or behave unexpectedly. Uptime and data persistence are not guaranteed. We recommend keeping external backups of any writing you value. See our Beta Disclaimer for additional detail.
6. Subscription and Billing
The Service offers a free tier (5 transforms per month) and paid subscription plans billed monthly or annually through Stripe. Billing terms, refunds, and cancellation rights are described in our Refund Policy and Cancellation Policy. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
7. Termination
You may cancel your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ends immediately.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE OR SUITABLE FOR ANY PURPOSE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kareem Elsamadicy SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
